By accessing or using SubsOnly ("the Platform"), you agree to be bound by these Terms of Service and all applicable laws and regulations. If you do not agree with any of these terms, you are prohibited from using or accessing the Platform. These Terms apply to all visitors, users, and others who access or use the Platform.
SubsOnly is a content monetization platform designed for Twitch streamers. The Platform enables creators to share exclusive content with their Twitch subscribers, manage subscriber tiers, send direct messages, and receive payments for premium content. SubsOnly integrates with Twitch's API to verify subscriber status and tier levels.
You must be at least 18 years of age to use the Platform. By using the Platform, you represent and warrant that you are at least 18 years old and have the legal capacity to enter into these Terms. If you are using the Platform on behalf of an organization, you represent that you have the authority to bind that organization to these Terms.
Creators are responsible for all content they publish on the Platform. By posting content, you represent that you own or have the necessary rights to that content, and that it does not infringe on any third-party intellectual property rights. Creators are solely responsible for the accuracy, quality, and legality of their content. SubsOnly reserves the right to remove content that violates these Terms or our Content Guidelines without notice.
SubsOnly retains a 30% platform fee on all transactions processed through the Platform. Creators receive 70% of gross revenue from post unlocks, store items, DM packs, and other paid features. Payouts are processed via PayPal upon creator request, subject to a minimum threshold. SubsOnly uses Stripe for payment processing. By accepting payments, you agree to Stripe's Terms of Service. SubsOnly does not store full payment card details.
The following content is strictly prohibited on the Platform: (a) content involving minors in any sexual context; (b) non-consensual intimate imagery; (c) content that promotes violence, terrorism, or illegal activity; (d) content that infringes on third-party intellectual property rights; (e) spam, misleading content, or fraudulent activity; (f) content that violates Twitch's Terms of Service. Violation of these prohibitions may result in immediate account termination and referral to law enforcement.
Creators retain ownership of all content they post on the Platform. By posting content, you grant SubsOnly a non-exclusive, worldwide, royalty-free license to display, distribute, and promote your content solely for the purpose of operating the Platform. SubsOnly retains all rights to the Platform's design, software, trademarks, and branding. You may not reproduce, distribute, or create derivative works from SubsOnly' proprietary materials without express written permission.
The Platform integrates with Twitch's API to verify subscriber status. By using the Platform, you authorize SubsOnly to access your Twitch account information as necessary to provide the service. SubsOnly' use of Twitch data is subject to Twitch's Developer Agreement and Privacy Policy. SubsOnly is not affiliated with, endorsed by, or sponsored by Twitch Interactive, Inc.
To the maximum extent permitted by applicable law, SubsOnly shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, or goodwill, arising out of or in connection with your use of the Platform. SubsOnly' total liability for any claim arising from these Terms or your use of the Platform shall not exceed the amount you paid to SubsOnly in the 12 months preceding the claim.
SubsOnly reserves the right to suspend or terminate your account at any time, with or without cause or notice, for conduct that violates these Terms or is harmful to other users, SubsOnly, or third parties. Upon termination, your right to use the Platform will immediately cease. Provisions of these Terms that by their nature should survive termination shall survive, including intellectual property provisions, warranty disclaimers, and limitations of liability.
SubsOnly reserves the right to modify these Terms at any time. We will provide notice of material changes by updating the "Last Updated" date at the top of this page and, where appropriate, by sending an email notification. Your continued use of the Platform after any changes constitutes your acceptance of the new Terms.
These Terms shall be governed by and construed in accordance with the laws of the State of Delaware, United States, without regard to its conflict of law provisions. Any disputes arising under these Terms shall be resolved through binding arbitration in accordance with the American Arbitration Association's rules.
